Our client was charged with DUI after having been pulled over by a Rolling Meadows Police Officer for improper lane usage. Mr. LaScola thoroughly reviewed the video recording of the traffic stop and detected that there was no painted dividing line on the public roadway the accused was travelling prior to her stop. Without delineated markings, it would be very difficult for the prosecution to prove that our client violated her lane. Mr. LaScola filed a Petition to Rescind the Statutory Summary Suspension and a Motion to Quash Arrest and Suppress Evidence arguing that the Officer neither had reasonable grounds nor probable cause to pull over our client. An evidentiary hearing at the Rolling Meadows courthouse and the Judge agreed with Mr. LaScola’s argument. The client’s license suspension was rescinded and the DUI was forced to be DISMISSED by the State.
